John Gannon, an attorney of Skoler-Abbott in Springfield, MA, developed this PowerPoint that goes over the minimum wage and overtime rules and how these intersect with agricultural and farm work. It was presented at the January 3, 2020 meeting of the New England Vegetable & Berry Growers Association.
Summary: The minimum wage and overtime pay rules are a complex area of the law filled with exceptions and exemptions that are not always easy to sort out. This is particularly true for agricultural employers, where federal law exempts some but certainly not all employees engaged in agriculture. This is further complicated by state laws that often have higher minimum wage requirements and stricter overtime exemption allowances.
